Licence security

Acceptable types of security

The Régie du bâtiment du Québec (RBQ) invites you to consult the table that shows the acceptable types of security and documents required. If you obtain licence security from a financial institution, only the following security forms mentioned in table will be accepted. For the time being, an irrevocable and unconditional letter of credit issued by a financial institution (a letter of guarantee from a bank) is not one of the security forms accepted by the RBQ.

1) An INDIVIDUAL surety insurance policy issued in favour of the Régie du bâtiment du Québec (sec. 28 1º)

Security issued by

  • A company that holds a surety insurance permit (sec. 29)
  • Another legal person authorized to act as surety1 (sec. 29)

Forms to submit

2A) A GROUP surety insurance policy issued in favour of the Régie du bâtiment du Québec (sec. 28 1º)

Security issued by

  • A company that holds a surety insurance permit (sec. 29)
  • Another legal person authorized to act as surety1 (sec. 29)

for the members of a contractors’ association

2B) A GROUP surety insurance policy issued in favour of the Régie du bâtiment du Québec (sec. 28 1º)

Security issued by

A contractors’ association (for its members) solidarily with:

  • a company that holds a surety insurance permit (sec. 29); )
  • another legal person authorized to act as surety1 (sec. 29).

Important note concerning this type of security

Certified cheques and bank drafts are submitted to the Ministère des Finances as “deposits and consignments.” Even if the contractor wishes to terminate his security, the security can only be released after 5 years. If a civil action is filed within the deadlines prescribed in subsection 37 and a final judgement is not rendered, the security is not released.

4. An irrevocable and unconditional letter of credit issued in favour of the Régie du bâtiment du Québec (sec. 28 3º)

  1. Legal persons authorized to act as surety

    Under the Bank Act(R.S.C., 1991, c.B-1), the Act respecting financial services cooperatives (R.S.Q., c. C-67.3), the Act respecting trust companies and savings companies (R.S.Q., c. S29.01) or the Act respecting insurance (R.S.Q., c. A-32).

  2. A bank, saving or credit union or savings company authorized to act as surety

    Under the Bank ACt (R.S.C., 1991, c. B-1), the Savings and Credit Unions Act (R.S.Q., c. C-4.1) and the Act respecting trust companies and savings companiers (R.S.Q., c. S-29.01).

  3. All the provisions of this form must also be an integral part of the form provided by the surety (or the contractor if acting as its own surety).
