1.1.1 Building contractor – New residential buildings covered by a guarantee plan, Class I

This licence subclass authorizes construction work on:   

  • a detached, semi-detached, or row-type single-family dwelling, whether or not it is held in divided co-ownership 
  • a multifamily building, from a duplex to a quintuplex, not held in divided co-ownership. 

It also authorizes construction work included in licence subclasses 2.6, 3.1, 4.1, 5.1 and 6.1 of Schedule II, when said work relates to a new residential building governed by this subclass.

Note: The mandatory guarantee plan applies solely to buildings that are entirely new.  

BUILDINGS COVERED BY THE GUARANTEE PLAN

A) BUILDINGS NOT HELD IN DIVIDED CO-OWNERSHIP:

  • detached, semi-detached or row-type single-family dwelling
  • multifamily building, from a duplex to a quintuplex, i.e., duplex, triplex, quadruplex and quintuplex.

B) BUILDINGS HELD IN DIVIDED CO-OWNERSHIP:

  • detached, semi-detached or row-type single-family dwelling.

C) PREFABRICATED BUILDING:

  • if the sales contract is concluded with the manufacturer and includes the complete installation of the prefabricated dwelling, the manufacturer must hold a general contractor’s licence and subscribe to the guarantee plan whose protection applies to the contract as a whole. 
  • if the contract for the sale and installation of a prefabricated dwelling is concluded with a general contractor, the latter must hold a subclass 1.1.1 licence and subscribe to the guarantee plan, whose protection applies to the contract as a whole.   
  • Furthermore, when the sales contract is concluded with the manufacturer but the installation contract is signed with a general contractor, the latter must hold a subclass 1.1.1 licence, but the guarantee plan shall only apply to work subject to the general contractor’s contract. 

SPECIALIZED WORK INCLUDED IN THIS LICENCE SUBCLASS

Work included in the following subclasses can be carried out by a contractor holding the 1.1.1 subclass licence, whether or not said work is listed in the licence, provided it relates to the construction of a new building governed by this subclass:

  • <link en guide-pour-determiner-la-licence-requise>6.1 Wood framing
  • All work included in <link en guide-pour-determiner-la-licence-requise>Schedule III.

This contractor is also authorized to carry out work covered by one or several of the aforementioned specialized subclasses when said work is part of a project relating to his licence subclass (1.1.1).

DEFINITION OF “BUILDING”

For the purposes of licence subclasses 1.1.1. and <link en guide-pour-determiner-la-licence-requise>1.1.2, “building” refers to the building itself, including installations and equipment required for its use, i.e. the artesian well, connections to municipal or government services, the septic tank and its absorption field, and the subsoil drain.  

NO LICENCE IS REQUIRED FOR THE FOLLOWING:

  • construction of a dwelling prefabricated in the plant   
  • work relating to the delivery of prefabricated dwelling (moving a building on the road). However, setting a prefabricated building on a foundation requires a contractor’s licence.   

Note to the owner-builder

The owner-builder who carries out the construction of a building on his own or with his own salaried workers or subcontractors, is not eligible for the guarantee plan.
